RE: The tariff classification of costume jewelry, mahogany boxes and carved cow horn ships from the Dominican Republic.

Dear Mr. Rodriguez:

In your letter dated June 27, 2000, you requested a tariff classification ruling.

The merchandise to be imported is as follows:

Costume jewelry made from silver and semiprecious stones such as amber, larimar and hematite, to include rings, necklaces and bracelets.

Small, lacquered mahogany wood boxes in various shapes. The boxes have covers or lids and are not lined. They are said to be suitable for storing jewelry and other small items such as buttons, pins, etc.

Carved cow horn model ships. The model ships are replicas of sailing ships made from pieces of carved and polished cow horn and wire. The applicable subheading for the silver and semiprecious stone jewelry will be 7113.11.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of jewelry and parts thereof… of silver, whether or not plated or clad with other precious metal: other: other. The rate of duty will be 5% ad valorem.

The applicable subheading for the boxes will be 4420.90.4500, HTS, which provides for jewelry boxes, silverware chests, microscope cases, tool or utensil cases and similar boxes, cases and chests, all the foregoing of wood: not lined with textile fabrics. The rate of duty will be 4.3% ad valorem.

The applicable subheading for the cow horn carved model ships will be 9601.90.6000, HTS, which provides for worked ivory, bone, tortoise-shell, horn…... and articles of these materials...other: of horn. The rate of duty will be free.

Articles classifiable under subheadings 7113.11.5000 and 4420.90.4500, HTS, which are products of the Dominican Republic, are eligible for duty-free treatment under the Caribbean Basin Economic Recovery Act (CBERA) upon compliance with all applicable regulations.

The importation of certain mahogany products may be subject to restrictions or regulations administered by the U.S. Department of Agriculture (U.S.D.A.) and/or the U.S. Fish and Wildlife Service. It is therefore suggested that, prior to importing this merchandise, you check with those agencies at the following locations:

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
